• Use any automated means, including robots, spiders, scrapers, or similar data gathering and extraction tools, to access the Site without our prior written consent.

The Site and its entire contents, features, and functionality — including all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof — are owned by DURAPLEX, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The DURAPLEX name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of DURAPLEX or its affiliates. You may not use these marks without our prior written permission.

You may view, download, and print pages from the Site for your own personal, non-commercial use, subject to the restrictions set out in these Terms. You must not modify the digital or paper copies of any materials you print or download, and you must not use any illustrations, photographs, video or audio sequences, or any graphics separately from any accompanying text.

If you submit any information to us through the Site — including through quote requests, contact forms, or reviews — you represent that the information is accurate and that you have the right to provide it. You grant DURAPLEX a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, and display any content you submit, in any media and for any lawful business purpose, subject to our Privacy Policy.

We make reasonable efforts to display product information, specifications, colors, and images as accurately as possible. However, we do not warrant that product descriptions, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free. Colors and finishes may appear differently on different displays, and physical samples may vary slightly from what is shown on the Site.

All products are subject to availability. We reserve the right to change, discontinue, or limit the availability of any product at any time without notice. Product warranties are governed separately by the DURAPLEX Warranty Program.

The Site may contain links to third-party websites or services that are not owned or controlled by DURAPLEX. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that DURAPLEX shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such third-party content, goods, or services.

THE SITE AND ALL CONTENT, MATERIALS, AND PRODUCTS DESCRIBED ON THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DURAPLEX DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DURAPLEX, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE OR ANY CONTENT ON THE SITE — INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, AND INCLUDING LOSS OF REVENUE, PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLES.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

You agree to defend, indemnify, and hold harmless DURAPLEX, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

These Terms and your use of the Site are governed by and construed in accordance with the laws of the United States and the state in which DURAPLEX maintains its principal place of business, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of these Terms or your use of the Site shall be brought exclusively in the federal or state courts located in that jurisdiction, and you consent to the personal jurisdiction of those courts.

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
