DURAPLEX SPC Floor Warranty Program

Each of the limited warranties described in this document is granted subject to all of the following conditions. Failure to meet any of these conditions voids coverage for the affected material under every warranty described in this document.

1. The floor must be installed properly and in accordance with the DURAPLEX Installation & Care Guide, using the click lock floating method.
2. All planks must be inspected before installation. Planks with visible damage or visible defects must not be installed; installing them voids coverage for that material.
3. The installation space must be climate controlled and held between 65°F and 85°F (18°C and 29°C) for at least 48 hours before installation and continuously thereafter. No acclimation period is required under those conditions. If the product has been stored or transported outside that range, it must be allowed to rest flat in the installation room, away from extreme heat and direct sunlight, for 48 hours before installation.
4. A ¼" (6 mm) expansion gap must be maintained around all edges of the installation and around pipes, door frames, and transitions.
5. The subfloor must be clean, dry, flat, and structurally sound before installation, and any subfloor moisture condition must be identified and corrected before the floor is installed.
6. The flooring must not be exposed to temperatures above 140°F (60°C) or below 32°F (0°C). This is an absolute limit that applies in addition to, and does not relax or replace, the climate control requirement set out above.
7. The flooring must be used only indoors in a climate controlled area.
8. Where the floor is installed over a radiant heat system, the heating elements must be fully embedded in the subfloor or in a cementitious leveling compound, the floor surface temperature must never exceed 85°F (29°C), and the system must be commissioned and operated in accordance with the radiant heat section of the DURAPLEX Installation & Care Guide.
9. The flooring must be maintained in accordance with the care and maintenance instructions in the DURAPLEX Installation & Care Guide.
10. The product must have been purchased new from an authorized DURAPLEX dealer.
11. These limited warranties do not apply to DURAPLEX moldings and trims.

None of the limited warranties described in this document cover the following. Individual warranties carry additional exclusions, which are set out in their own sections below.

1. Damage due to adhesives or tape, scratches, gouges, scuffs, punctures, cuts, indentations, burns, accidents, lack of proper furniture rests such as chair pads, etc., rolling and/or non-foot traffic, or any intentional misuse of the product. Loss of finish gloss over time is consistent with normal wear & tear and is not a product flaw. This item does not apply to ordinary rolling traffic in a space covered by the 5 Year Limited Light Commercial Wear Warranty where appropriate floor protectors are used as required by that warranty.
2. Damage resulting from installation that does not follow the DURAPLEX Installation & Care Guide, including installation outside the temperature conditions set out above, insufficient or obstructed expansion gaps, installation over an unsuitable, uneven, or damp subfloor, inadequate subfloor preparation, and telegraphing of subfloor irregularities through the installed floor.
3. Damage resulting from the installation of planks with visible damage or visible defects.
4. Damage resulting from improper maintenance, including the use of abrasive cleaners, ammonia, bleach, or mop-and-shine products, and damage caused by dragging furniture or appliances across the floor.
5. It is normal and expected for there to be color variations due to use of natural components, exposure to UV light and/or sunlight, and age of material. Therefore, color inconsistency between samples, replacement product or illustrations and actual product is not a manufacturing flaw.
6. Manufacturer makes no guarantee that DURAPLEX products will match or coordinate with customer furnishings, trim, cabinetry, railings, etc.
7. Noncompliance with installation instructions and maintenance guidelines as recommended by DURAPLEX. Manufacturer cannot assume responsibility for the suitability of flooring material and accompanying products for each individual installation as manufacturer has no control over the installer's proper application.
8. Cracking, warping, soiling, fading, improper maintenance or abuse caused by items such as roller skates, golf shoes or pets.
9. Floor covering installed in a location that is not a climate controlled interior area, or that is otherwise unsuitable for resilient flooring, including outdoor areas, unconditioned garages, porches, saunas, and any area subject to standing water.
10. Gloss reduction or surface scratches are not considered surface wear. Dull finish can be corrected with spot or overall recoating care systems.
11. Damage to floor caused by exposure to temperatures above 140°F (60°C) or below 32°F (0°C).
12. Damage resulting from a radiant heat system whose heating elements are not fully embedded as required, that is operated at a floor surface temperature above 85°F (29°C), or that is brought up to or down from temperature more rapidly than the DURAPLEX Installation & Care Guide allows.
13. Product not purchased new from an authorized DURAPLEX dealer.
14. Labor, installation, removal, disposal, freight, or any other costs associated with the repair or replacement of the product. Coverage is limited to material only.

The vinyl wear layer of the floor plank is warranted by DURAPLEX not to wear through under normal use for 10 years from date of purchase. Wear-through is defined as 100% loss of the vinyl wear layer exposing the core material beneath it, over a minimum of 5% of the total installation, occurring within a single contiguous area. (Gloss reduction or surface scratches are not considered surface wear.) Dull finish can be corrected with spot or overall recoating care systems.

If wear-through as defined above is determined to have occurred, DURAPLEX will arrange a credit according to the schedule set out below in the section headed “Terms of 10 Year Limited Residential Wear Warranty,” under which the credit is pro-rated after the first year. This warranty is non-transferable and applies only to the original purchaser.

This warranty is granted subject to the conditions and exclusions set out above in the sections headed “Conditions Applicable to All DURAPLEX Limited Warranties” and “Exclusions Applicable to All DURAPLEX Limited Warranties.”

The floor plank is warranted to be free from manufacturing or material defects for the life of the product. Should a defect occur, DURAPLEX will arrange a credit according to the schedule set out below in the section headed “Terms of Lifetime Limited Warranties,” under which the credit is pro-rated after the first year. This warranty is non-transferable and applies only to the original purchaser.

Coverage: Upon determination of a valid manufacturing defect, credit will be issued to the dealer of record and will be good toward the purchase of a replacement. Credit applies to material only and does not include labor, since it is the responsibility of the installer to determine suitability of material prior to installation. This applies both before and after the material has been installed.

This warranty is granted subject to the conditions and exclusions set out above in the sections headed “Conditions Applicable to All DURAPLEX Limited Warranties” and “Exclusions Applicable to All DURAPLEX Limited Warranties.”

The floor plank is warranted to be 100% waterproof and the structural integrity of the floor plank will not be significantly diminished by exposure to water for the life of the product. While moisture will not affect the floor's integrity, it is probable that, when excessive moisture accumulates in buildings or on building materials, mold and/or mildew growth can occur (particularly if the moisture problem remains undiscovered or unaddressed). DURAPLEX's moisture warranty excludes damage resulting from mold and/or mildew growth due to prolonged exposure to moisture.

If the floor plank is structurally impaired resulting from exposure to water, DURAPLEX will arrange a credit according to the schedule set out below in the section headed “Terms of Lifetime Limited Warranties,” under which the credit is pro-rated after the first year. This warranty is non-transferable and applies only to the original purchaser.

This warranty excludes all casualty events involving water coming in contact with your floor and failures normally covered by homeowners insurance including, but not limited to, damages caused by flooding or standing water from leaky pipes, faucets, or household appliances. Also excluded are damages caused by flooding or standing water from hydrostatic pressure or other casualty events.

In addition to the exclusions applicable to all DURAPLEX limited warranties, the Lifetime Limited Waterproof Warranty does not cover:

1. Damage to surrounding structure, walls, subfloor, fixtures, furniture, underlayment, moldings, trims, subfloor heating elements, or anything that is not the floor plank.
2. Damage resulting from mold & mildew growth due to prolonged exposure to moisture.
3. Flooring that is installed outdoors.
4. Labor, installation, removal, disposal, freight, or any other costs associated with the repair or replacement of the product. Coverage is limited to material only.

This warranty is granted subject to the conditions and exclusions set out above in the sections headed “Conditions Applicable to All DURAPLEX Limited Warranties” and “Exclusions Applicable to All DURAPLEX Limited Warranties.”

• Within One Year: Claims reported in writing within one year of purchase — DURAPLEX will replace the affected product or arrange a credit of 100% of the original purchase price of the affected material.
• Between Year One - Five: Claims reported in writing after one year but within five years — DURAPLEX will replace the affected product or arrange a credit of 50% of the original purchase price of the affected material.
• Between Year Five - Ten: Claims reported in writing after five years but within ten years — DURAPLEX will replace the affected product or arrange a credit of 25% of the original purchase price of the affected material.

Credit is calculated on the original purchase price of the affected material only, and the choice between replacement and credit is DURAPLEX's. All remedies under this warranty are limited to material only. Labor, installation, removal, disposal, and any other associated costs are not covered.

• Within One Year: Claims reported in writing within one year of purchase — DURAPLEX will replace the affected product or arrange a credit of 100% of the original purchase price of the affected material.
• Between Year One - Five: Claims reported after one year but within five years — DURAPLEX will replace the affected product or arrange a credit of 50% of the original purchase price of the affected material.
• Between Year Five - Ten: Claims reported after five years but within ten years — DURAPLEX will replace the affected product or arrange a credit of 25% of the original purchase price of the affected material.
• After Ten Years: Claims reported after ten years — DURAPLEX will provide sufficient replacement product to repair the defective area or arrange a credit of 10% of the original purchase price of the affected material.

Credit is calculated on the original purchase price of the affected material only, and the choice between replacement and credit is DURAPLEX's. All remedies under these warranties are limited to material only. Labor, installation, removal, disposal, and any other associated costs are not covered.

The vinyl wear layer of the floor plank is warranted by DURAPLEX not to wear through under normal light commercial use for a period of five (5) years from the date of purchase. Wear-through is defined as 100% loss of the vinyl wear layer exposing the core material beneath it, over a minimum of 5% of the total installation, occurring within a single contiguous area. (Gloss reduction or surface scratches are not considered surface wear.)

This warranty is non-transferable and applies only to the original purchaser and only if used in the following commercial areas:

• Retail: Novelty Shops/Boutiques, Product Display Areas, Sales Floors, Showrooms, Hair Salons
• Medical Offices: Waiting Rooms, Patient Rooms, Examination Rooms, Storage Rooms
• Hotels: Guest Rooms, Conference/Meeting Rooms
• Offices and Restaurants: Offices, Conference/Meeting Rooms, Showrooms, Restaurant Floor, Break Rooms
• Institutional and Light Industrial: Classrooms, Training Rooms, Meeting Rooms, Commons Areas, Residence Halls

In addition to the exclusions applicable to all DURAPLEX limited warranties, the 5 Year Limited Light Commercial Wear Warranty does not cover:

1. Use of the flooring in any commercial area not listed above, including areas subject to heavy or industrial traffic, forklift or pallet-jack traffic, or point loading from equipment or fixtures.
2. Damage caused by rolling loads, casters, or chairs without appropriate floor protectors.

This warranty is granted subject to the conditions and exclusions set out above in the sections headed “Conditions Applicable to All DURAPLEX Limited Warranties” and “Exclusions Applicable to All DURAPLEX Limited Warranties.”

• Within One Year: Claims reported in writing within one year of purchase — DURAPLEX will replace the affected product or arrange a credit of 100% of the original purchase price of the affected material.
• Between Year One - Three: Claims reported after one year but within three years — DURAPLEX will replace the affected product or arrange a credit of 50% of the original purchase price of the affected material.
• Between Year Three - Five: Claims reported after three years but within five years — DURAPLEX will replace the affected product or arrange a credit of 25% of the original purchase price of the affected material.

Credit is calculated on the original purchase price of the affected material only, and the choice between replacement and credit is DURAPLEX's. All remedies under this warranty are limited to material only. Labor, installation, removal, disposal, and any other associated costs are not covered.

Installation and Maintenance Instructions: The DURAPLEX Installation & Care Guide is incorporated into these limited warranties by reference and forms part of them. It is published at duraplexfloor.com and is supplied with the product. Where these limited warranties refer to DURAPLEX installation instructions or DURAPLEX maintenance instructions, they refer to that guide as published on the date the product was purchased.

Sole and Exclusive Remedy: Replacement of the affected material, or the pro-rated credit set out in the applicable Terms section above, is the sole and exclusive remedy under these limited warranties. All remedies are limited to the material itself.

Original Purchase Price: References to the original purchase price of the affected material mean the price paid by the original purchaser for the quantity of material actually affected by the valid claim, as shown on the proof of purchase, exclusive of any labor, installation, delivery, accessory, or other charges. It does not mean the price of the entire original order.

Limitation of Total Liability: In no event shall DURAPLEX's total aggregate liability under these limited warranties, for any and all claims relating to a single installation, exceed the original purchase price paid for the DURAPLEX product in that installation.

Discontinued and Substituted Product: Where the original product has been discontinued or is otherwise unavailable, DURAPLEX may satisfy a replacement remedy by supplying a comparable current product of equal or greater value. Replacement product may differ in color, gloss, texture, or dye lot from the originally installed material, and such variation is not a defect and is not itself a basis for a claim.

No Incidental or Consequential Damages: In no event shall DURAPLEX be liable for any incidental, special, indirect, or consequential damages of any kind arising out of the purchase, installation, use, or failure of the product. This includes, without limitation, labor and installation charges, the cost of removing or replacing the product, damage to or loss of use of the premises, the cost of moving or storing furniture or fixtures, lodging or relocation expenses, lost profits, and loss of time or inconvenience.

Implied Warranties: Any implied warranty, including any implied warranty of merchantability or fitness for a particular purpose, is limited in duration to the term of the applicable express limited warranty set out above.

State Law Rights: Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. These limited warranties give you specific legal rights, and you may also have other rights which vary from state to state.

Product Not Covered: These limited warranties do not apply to product sold as second quality, seconds, closeout, clearance, or discontinued stock, or sold “as is,” or to samples, moldings, trims, and accessories. Product in those categories is sold without warranty of any kind. This item refers to the basis on which the product was sold; it does not withdraw coverage from product that was sold as current stock and whose line DURAPLEX later discontinues.

Transferability: These limited warranties are non-transferable and extend only to the original purchaser of the product for the original installation. They do not extend to any subsequent owner or occupant of the structure.

No Modification: No dealer, retailer, installer, distributor, agent, or employee has authority to modify these limited warranties or to make any additional warranty or representation on behalf of DURAPLEX. This document is the entire warranty offered by DURAPLEX for the products described in it and supersedes all prior warranty statements.

Severability: If any provision of these limited warranties is held to be invalid, unenforceable, or inapplicable in any jurisdiction, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
